The following Privacy Policy will provide you with information about the personal data that is collected and how it is processed and used.

Thoughtfish will alter the Privacy Policy from time to time. Please note that the valid version is the updated one.

1. Subject Matter of this Privacy Policy

Thoughtfish GmbH (“Thoughtfish”, “us”, “our” or “we”) is dedicated to protecting the privacy rights of our users (“users” or “you”). This Privacy Policy (the “Policy”) describes the ways we collect, store, use, and manage the information, including personal information, that you provide or we collect in connection with our websites, including www.thoughtfish.de, www.trucify.com, www.fightlings.com (the “Sites”) or any Thoughtfish game provided on a mobile platform (for example, iOS and Android)(collectively, the “Service”). Please note that the scope of this Policy is limited to information collected or received by Thoughtfish through your use of the Service. Thoughtfish is not responsible for the actions of third party people or companies, the content of their sites, the use of information you provide to them, or any products or services they may offer. Any link to those sites does not constitute our sponsorship of, or affiliation with, those people or companies.

By using the Service, you are expressing your agreement to this Policy and the processing of your data, including your personal information, in the manner provided in this Policy. If you do not agree to these terms, please do not use the Service.

 

2. Information Requests

In case you have any questions concerning privacy policy issues, please do not hesitate to contact datenschutz@thoughtfish.de. At this address, you can inquire about privacy issues as well as review, change, or delete your personal data stored by Thoughtfish. This will cause you no other costs than your usual transmission costs (i.e. the costs of your Internet, e-mail, mobile phone or telephone connection). Alternatively, you can also contact us using the above postal address.

Please note: Before furnishing any information, we may insist on being sent some form of documentation to prove the enquirer’s identity and confirm its authenticity.

3. Information Collection and Use

Thoughtfish collects information as described below. Our primary goals in collecting and using information is to create your account, provide Services to you, improve our Service, contact you, conduct research and create reports for internal use. We store information on servers located in Germany via Amazon Web Services and may store information on servers and equipment in other countries.

4. Privacy Policy on our Websites

In server log files, Thoughtfish automatically collects and saves the following information that your browser relays to us:

  • Browser type and version
  • Operating system
  • Referrer URL (the website visited prior to ours)
  • IP address
  • Time of your query

These data cannot be related to a specific person. We do not merge these data with other sources. After a statistical analysis, these data are deleted regularly.

If you register on our website, participate in competitions or subscribe to our newsletter, it is necessary that you provide us with personal data. This data may include, for example, your name, address, email address or other personal data that will be requested by Thoughtfish in individual cases.

4.1. Cookies

Cookies are miniature files that can be saved temporarily or permanently to your hard drive to recognize a re-visiting user. This website does not use cookies with the exception of Google Analytics (see below). If you wish to prevent cookies from being installed in general or would like to delete individual cookies, please follow the instructions of the manufacturer of your browser.

4.2. Google Analytics

This website uses Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies”, i.e. text files that are stored on your computer to enable your use of the website to be analyzed. The information relating to your use of this website generated by the cookie is usually transmitted to and stored by a Google server in the USA. If IP anonymization is activated on this website, however, your IP address will be shortened beforehand by Google within member states of the European Union or other contracting states to the Treaty on the European Economic Area. The full IP address will be transmitted to a Google server in the USA and shortened there only on an exceptional basis. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of this website, compiling website activity reports and providing further services relating to website activity and internet use to Thoughtfish. The IP address transmitted from your browser via Google Analytics will not be associated with any other data held by Google. You may prevent the use of cookies by selecting the appropriate setting in your browser software; however, please note that in this case you may not be able to use all functions of this website to their full extent. You may also prevent the collection and processing of the data generated by the cookie and relating to your use of this website (including your IP address) by Google by downloading and installing the browser plug-in, which is available here.

4.3. Crashlytics

We use Crashlytics — a service offered by Fabric — a company owned by Google Inc. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Crashlytics provides us with information about crashes and malfunctions in this application. In case of malfunction or failure, the following information is transmitted to Crashlytics and collected by us:

  • IP-address of the device
  • information about the device, such as: device ID, model and device type, name and version of the OS, settings and language of the device
  • version and functionality of the application
  • time of failure

Data transmitted to Crashlytics is neither stored or transferred to other services or resources, nor associated with other data available to Google.

5. Use of Other Plugins

Our games, services and websites may also contain other plugins. Each plugin is the responsibility of its provider (e.g. Twitter, Google). This means that we have no control over the amount of information that the respective provider collects with the help of its own plugin, or how it then uses that information. If the user is not yet a customer of the provider or has not (yet) consented there to having his/her data collected and used, we recommend not clicking on these plugins. If, on the other hand, the user is already a customer of the plugin provider, he/she should refer directly to the relevant provider for information on the kind and amount of personal data it collects and uses, and for what purpose.

6. iOS and Android Platforms

When you use any of the Thoughtfish games or applications on a mobile platform, we may collect and record certain information such as your unique device ID (persistent / non-persistent), hardware type, media access control (“MAC”) address, international mobile equipment identity (“IMEI”), the version of your operating system (“OS”), your device name and your email address (if you have connected to Facebook or Google+). This information is useful to us for troubleshooting and helps us understand usage trends.

 

In addition, we create a unique user ID to track your use of our Service. This unique user ID is stored in connection with your profile information to track the Thoughtfish games you are playing.

7. Facebook Connect

Thoughtfish uses plugins to enable the invitation of Friends via Facebook, from the social networking site facebook.com. These plugins are operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The plugins can either be identified by one of the Facebook logos (a white “f” on a blue tile or a “thumbs up” sign), or by being specially marked “Facebook Social Plugin”.

If a user pushes the button “Invite via Facebook”, his or her internet browser connects directly with the Facebook servers. Facebook sends the content of the plugins directly to the user’s browser and back. Since we have absolutely no control over the amount of data that Facebook collects with the help of these plugins, we would like to share our latest knowledge with you: If the user is logged in on Facebook at the same time, Facebook can allocate the visit to the user’s personal Facebook account. If the user interacts with the plugins, that information is immediately transmitted by the browser directly to Facebook, where it is saved. If the user is not using Facebook, the service can still collect and store the IP address. More information on how much data is collected and why, and how it is then processed and used by Facebook, as well as details about the users’ rights and the settings available for protecting users’ privacy, can be obtained from Facebook’s data protection policy at www.facebook.com/policy.php. If a user has signed up to Facebook but does not want Facebook to collect data and link it up with the data stored on Facebook, he/she must log off Facebook. If you have no Facebook account and/or have not (yet) consented to have your data collected and used by Facebook, we recommend you not use or activate Facebook plugins.

8. Customer Service

We may collect your email address when you contact our support crew and we may use that email address to contact you about your gaming experience with Thoughtfish games and notify you about company news and promotions. If you no longer wish to receive certain email notifications you may opt-out at any time by following the unsubscribe link located at the bottom of each communication.

9. Push Notifications

We may occasionally send push notifications through our mobile applications to send you game updates and other service-related notifications that may be of importance to you. You may opt-out of receiving these types of communications at any time by turning them off at the device level through your settings.

10. Game Data Collection

Whenever you play our games, we collect data about all of your interactions with the game and with the other players inside the game via server log files. This information may be associated with your player ID, IP address, or device ID for the purpose of providing you our Services and improving them. This data is stored within Amazon Web Services.

11. Other Collection

We may provide you the opportunity to participate in a sweepstakes or contest through our Service. If you participate, we will request certain personal information from you. Participation in these sweepstakes and contests are voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code).

 

We use this information to notify winners and award prizes, to monitor traffic, or to personalize the Service. We may use a third-party service provider to conduct these sweepstakes or contests; that company is prohibited from using our users’ personal information for any other purpose.

12. Mobile Analytics

We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your device. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and from where the application was downloaded. We do not link the information we store within the analytics software to any personal information you submit within the mobile application.

13. How We Use Information

We use information collected through our Service for purposes described in this Policy or disclosed to you in connection with our Service. For example, we may use your information to:

  • create game accounts and allow users to play our games
  • identify and suggest connections with other Thoughtfish users (i.e. Matchmaking)
  • operate and improve our Service
  • understand you and your preferences to enhance your experience and enjoyment using our Service
  • respond to your comments and questions and provide customer service
  • provide and deliver products and services you request
  • send you related information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages
  • communicate with you about promotions, rewards, upcoming events, and other news about products and services offered by Thoughtfish and our selected partners
  • enable you to communicate with other users
  • link or combine it with other information we get from third parties, to help understand your preferences and provide you with better services.

 

14. Duration of storage

Thoughtfish does not share your personal information except as approved by you or as described below:

 

Thoughtfish may engage other companies and individuals to perform services on our behalf. An example of these services includes analyzing data and providing customer support. These agents and service providers may have access to your personal information in connection with the performance of services for Thoughtfish.

We may release your information as permitted by law, such as to comply with a subpoena, or when we believe that release is appropriate to comply with the law; investigate fraud, respond to a government request, enforce or apply our rights; or protect the rights, property, or safety of us or our users, or others. This includes exchanging information with other companies and organizations for fraud protection.

Thoughtfish may share your information in connection with any merger, sale of our assets, or a financing or acquisition of all or a portion of our business to another company. You will be notified via email and/or notice on our site of any change in ownership or users of your personal information.

We may share aggregate or anonymous information about you with advertisers, publishers, business partners, sponsors, and other third parties.

15. Security

Thoughtfish takes reasonable measures to protect your information from unauthorized access or against loss, misuse or alteration by third parties.

 

Although we make good-faith efforts to store the information collected on the Service in a secure operating environment that is not available to the public, we cannot guarantee the absolute security of that information during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining access to this information. We do not warrant or represent that your information will be protected against, loss, misuse, or alteration by third parties. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

16.Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us at datenschutz@thoughtfish.de. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

17. Our Policy Regarding Children

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to use our Service. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of 13 may provide any personal information. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as soon as possible. 18. International Transfer

We may transfer information that we collect about you to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world.
